NELA Calls On Department Of Labor To Fight For Overtime Pay For Over Four Million Workers

The National Employment Lawyers Association (NELA) commends the decision of the U.S. Department of Labor (DOL) to appeal U.S. District Court Judge Amos Mazzant’s August 31, 2017 summary judgment ruling against DOL implementation of what is known as the Overtime Rule. We urge Secretary of Labor Alexander Acosta to use the resources of the DOL to seek to preserve the $47,476 salary threshold set in the new Rule for overtime pay, thereby ensuring that millions of overworked employees in the United States receive full compensation for all of the hours they actually work.
Prior to promulgating the Rule, DOL spent years conducting extensive empirical research and outreach to affected communities, and considered the views of nearly 300,000 employees, businesses, and other stakeholders. The rights of over four million workers to fair compensation when they work overtime should not be delayed any longer.
NELA calls on U.S. Secretary of Labor Alexander Acosta to honor President Trump’s repeated promises to stand up for working people across this country, abide by the DOL’s mission to “foster, promote and develop the welfare of the wage earners, job seekers and retirees of the United States,” and fight to preserve the $47,476 salary threshold.
